DMCA Policy

Memento Amari LLC ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), we will respond promptly to notices of alleged copyright infringement that comply with the DMCA.

Reporting Copyright Infringement

If you believe that content available through the Dashed application infringes your copyright, please submit a written notification containing the following information:

  1. Identification of the copyrighted work you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list.
  2. Identification of the material that you claim is infringing and that you want removed or disabled, with enough detail for us to locate it (e.g., recipe title, source URL, user account if known).
  3. Your contact information, including your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
  6. Your physical or electronic signature (or the signature of a person authorized to act on your behalf).

How We Respond

Upon receiving a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing material
  2. Notify the user who imported or created the content
  3. Provide the user with information about submitting a counter-notification

Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:

  1. Identification of the material that was removed or disabled and where it appeared before removal.
  2. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Memento Amari LLC may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  4. Your physical or electronic signature.

Restoration of Content

If we receive a valid counter-notification, we will forward it to the original complaining party. If the original party does not file a court action within 10 business days, we may restore the removed content.

Repeat Infringers

We will terminate the accounts of users who are repeat infringers in appropriate circumstances.

Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
